Dick, Now you know why I left Massachusetts.....just kidding! What a bummer, what a streak of bad luck. First and obviously, make sure everyone is physically okay. Then worry about the car. Take it to wherever you want it fixed right, then get an estimate, give it to the tow owner and see how he replies. If he won't give you a check, then submit to your insurance company and let them fight it out with his. Absolute last resort is legal action. If your insurance company is reasonable and you have full coverage, shouldn't be much of an issue (less your deductible).
