By Article 1.3, the game ends immediately with the result a draw. No one
has to claim anything. (See also Article 9.6).

By the way, my computer counts 1256+1256 = 2512 positions reachable from
your position without A1.3, not 2440. (1256 with White to play, and 1256
with Black to play.)
