On the House side, Rep. Folwell (R) has indicated he too will soon be introducing a similar bill. Since SB13/Injury to Pregnant Woman recognizes only one victim, North Carolina Right to Life cannot support it and will in fact oppose it. We write to ask you and all those within your sphere of influence to join North Carolina Right to Life in opposing SB13 for the reasons stated below. North Carolina Right to Life supports legislation that recognizes the unborn child as a second victim when a crime is committed against the mother and her unborn child is injured or killed. The laws of thirty-five other states recogni ze the unborn child as a second victim (http://www.nrlc.org/Unborn_victims/Statehomicidelaws092302.html). However, North Carolina law is gravely deficient - recognizing only the "pregnant woman" as the single victim in these barbaric crimes. Public policy should reflect the loss of two victims, not just one. Single victim laws do not allow the State to prosecute defendants for the taking of two lives and therefore cannot bring justice for these victims or their families. Both federal and state courts have universally upheld fetal homicide laws (http://www.nrlc.org/Unborn_victims/statechallenges.html). Abortion proponent Dianne Feinstein (D-CA) has refused to recognize the unborn child in any legal context, offering substitute language specifically removing any reference whatsoever to the child in utero. In this way, SB13/Injury20to Pregnant Woman is similar to the Feinstein single-victim substitute that Congress ultimately rejected. SB13/Injury to Pregnant Woman omits any reference to the unborn child, and like the Feinstein bill, would say to the victims' families that there was no second victim; this perpetuates the horrendous injustice already committed against them. "I hope that every legislator will clearly understand that adoption of such a single-victim amendment would be a painful blow to those, like me, who are left alive after a two-victim crime, because Congress would be saying that Conner and other innocent unborn victims like him are not really victims - indeed, that they never really existed at all. But our grandson did live. He had a name, he was loved, and his life was violently taken from him before he ever saw the sun . The application of a single victim law . would be even more offensive in the many cases that involved mothers who themselves survive criminal attacks, but who lose their babies in those crimes . In addition, SB13/Injury to Pregnant Woman draws an arbitrary line in a woman's pregnancy, failing to provide any recognition of unborn victims who have not yet crossed that line because their lives were violently taken from them. North Carolina Right to Life will, upon request, provide language that would recognize and bring justice for both the mother and her unborn child where violent crimes have been committed against them. Under a policy of President George W. Bush from 2001-2008, known as the "Mexico City Policy," funds appropriated to the U.S. "population assistance" program went only to overseas organizations that pledged not to perform or promote abortion as a birth control method. However, on January 23, 2009, President Obama issued a directive that nullified that policy. Today, Senator Mel Martinez (R-Fl.) offered an amendment that would reverse the Obama order, and restore a ban on tax funding of overseas organizations "that performs or actively promotes abortion as a method of birth control." The amendment, which was supported by NRLC, failed on a vote of 60-37, wit h Senator Burr voting for the amendment. NRLC Legislative Director Douglas Johnson commented: "President Obama has opened the pipeline for hundreds of millions of tax dollars to flow to private organizations that perform and promote abortion as a method of birth control overseas. We commend Senator Burr for supporting today's attempt to block the Obama order - an order that certainly will lead to many more abortions. "The Obama order is all the more troubling when we consider that this was just the first in a series of pro-abortion policy changes that will be pushed forward by the Obama Administration," Johnson said. "In the months ahead, we expect to see an attempt to repeal the Hyde Amendment, which would result in tax-funded abortion as a birth control method in the United States, and imposition of sweeping pro-abortion mandates on private employers through health-care reform legislation." Contrary to some misunderstandings, enforcement of the Mexico City Policy did not reduce the amount of money spent on the overseas family-planning program, nor will Obama's order increase the amount (which is $461 million in the current fiscal year). Rather, the policy affects what type of groups qualify for grants under the program. "Obama's order will predictably result in a redirection of funds to groups which perform abortions and are ideologically committed to the doctrine that abortion on demand must be universally available as a birth control method," Johnson said. The details of the Mexico City Policy are spelled out in an official handbook issued by the U.S. Agency for International Development (USAID), which is available on request from NRLC (in PDF format). Basically, the policy required grantees to refrain from performing abortions (except to save the life of the mother, or in cases of rape or incest), or lobbying to legalize abortion, or otherwise promoting abortion as a family-planning method. The policy explicitly allowed responding to questions about where abortions may be obtained, in countries in which abortions are legal. The National Right to Life Committee is the nation's largest pro-life group with affiliates in all 50 states and over 3,000 local chapters nationwide.
