Not to say the it's the seller's fault, as if the person took advantage of them and stole the car without paying they should be prosecuted.

But you don't sign a title over and then hand it to the buyer with the car prior to getting paid! Once you do that, the car is considered sold and legitimate, especially if/when the buyer transfers title over to his name, and the burden of proof to show if's been stolen becomes the seller's problem.

Where if he has the car, but not a signed title, the burden of proof is on the "buyer" to prove the car is his legitimately.

My newest Missouri title requires a notarized signature to release any lien (on the front of the title), but no indication of the need for (or any room for) notarizing on the back for a simple title transfer.
