1. "APARTHEID ON THE PRAIRIE" - A PR DEBACLE

The Jewish Council for Public Affairs, the umbrella arm of the =
organized Jewish community in the United States, has scheduled a debate =
on the subject of Israel's settlement policies for their annual =
conference, which is slated for February 23rd in Baltimore.=20
JCPA had received a volume of material culled from organizations =
that have made the case to the American government and the Jewish =
community in the US that the Jewish communities Israel established =
beyond the1948/1967 armistice lines has been some kind of criminal act, =
and that these Jewish communities somehow stand as an obstacle to peace. =
It would surprise most people to know that the Israeli Jewish =
communities of Judea, Samaria, Katif (Gaza) (Yesha) and the Golan =
Heights have not displaced a single Arab village, because of a principle =
laid down by Prime Minister Menachem Begin in 1977. Begin insisted that =
no Jewish town in the areas to be settled by Israel would displace an =
Arab village - unlike the policies of the Israeli Labor party, which - =
as a matter of policy - built Jewish communities to replace the 531 Arab =
villages abandoned by their Arab residents during the 1948 war.=20
Yet the PLO/Peace-Now misinformation machine, working with funding =
from the European Union, has set up an organization known as "Settlement =
Watch", which swamps the media with timely reports that portray the =
Jewish residents of Yesha as criminal interlopers who have encroached on =
Arab land. An array of human rights organizations, all funded through =
the New Israel Fund (NIF) and the EU, overwhelm the media with =
supportive data, with the aim of painting the ugliest picture possible =
of the Jewish residents of these areas. All you have to do is to read =
the reports of B'tzelem, the human rights organization, funded by the =
NIF and the EU and staffed by Arab researchers sympathetic to the PLO, =
and you will get the idea that the Jews of Yesha must have been trained =
by gangster Louis Lepke's Murder, Incorporated.=20
What the PLO and Peace Now do to "sell" their claim of the =
"settler-criminals" to the media is to operate tours of the Jewish =
communities of Yesha for the clueless foreign media. We have confirmed =
with Peace Now spokesmen that they actually tell the reporters that the =
settlers live in caves, waiting in ambush to pounce on passing Arab =
vehicles. We have also confirmed with Peace Now spokesmen that they will =
actually stand on top of a hill overlooking Gush Etzion with their media =
guests and say to them that the entire area was stolen from Arab =
farmers, portraying the Jews there as the personification of "apartheid =
on the prairie".=20
To paraphrase the Nazi propagandist Josef Goebels, a lie repeated =
often enough becomes believable. A lie which is repeatedly sold to the =
media with no rebuttal becomes part of the media gospel.=20
It is difficult to forget the Peace Now press conference in =
November, 2000, when Peace Now appealed to the PLO to stop firing in the =
direction of the Jerusalem neighborhood of Gilo. Only in the direction =
of Gilo. Murdering Jews elsewhere beyond the =93Green Line=94 was =
therefore permissible.=20
The strategy of demonizing the Jewish population of Yesha was =
formally proposed to Prime Minister Yitzhak Rabin by his public =
relations maven, Yekutiel Federman, on the pages of the Mapam political =
publication, Al HaMishmar, in October 1993. Federman's strategy was =
carefully adopted as the methodology of promoting the Oslo process. In =
depends on portraying "land-grabbing Jews" in Yesha and the Golan as the =
5% of the Israeli population that stands in the way of peace with the =
PLO, which supposedly became Israel's peace partners and which was =
supposedly ready to settle for the West Bank and Gaza as the area for an =
eventual Palestinian Arab entity. Jews who raised questions about the =
Oslo process were simply defined as "warmongers". The fact that for the =
past ten years the PLO and the Palestinian Authority have continued to =
demand all of Palestine, in all Arabic public statements and all Arabic =
publications, has hardly been reported. In fact, in a parting opinion =
article (Ha=92aretz Feb. 5, 2002) as a member of the Knesset, Peace Now =
founder and Meretz MK Professor Amnon Rubinstein noted that the PLO =
defines the entire state of Israel as one immense illegal settlement, =
where it is permissible for the PLO to murder Jews.=20
It is my hope and prayer that Jewish organizations will allocate =
resources to facilitate tours of Judea, Samaria, Katif and Jerusalem for =
foreign journalists, along with well-researched reports, to counter =
hostile propaganda with factual press briefings, interviews with victims =
of terror, and more.=20
Meanwhile, if the JCPA does pass a resolution that calls on Israel =
to remove Jews from Judea, Samaria, Katif and the Golan, then the name =
of the organization may soon be changed to the =93Judenrein Council for =
Public Affairs=94.=20

2. WHEN HAVE MILLIONS OF EUROPEANS EVER BEEN WRONG?

With millions of Europeans demonstrating against America, many =
Americans, raised to regard Europe as an ally, must be wondering what is =
happening. Some Americans even may be wondering if Europe may be right: =
after all, when have millions of Europeans ever been wrong?=20
It is therefore essential that Americans understand the nature of =
the rift between America and Western Europe (not Eastern Europe, which =
thanks to its suffering under Communist evil, understands evil and =
values America) -- a rift that will only widen unless one adopts the =
values of the other. For at this moment, there are two civilizational =
wars taking place: Islamist hostility to Western liberty and European =
hostility to American values.=20
Why this European hostility?=20
First, Europe believes in socialism, while America believes in =
capitalism. This difference can hardly be overstated. Most Western =
Europeans believe in socialism as fervently as religious Christians, =
Jews and Muslims believe in their respective religions. To many =
Americans, socialism is only an economic system, but for Western =
Europeans it has largely replaced Christianity as their faith.=20
The United States not only rejects socialism; it is the chief =
obstacle to its spread -- because of its military and cultural might, =
and especially because of its economic success. Indeed, America is the =
chief impediment to the spread of both Islam and socialism. This =
explains the unity of leftist and Muslim activists. Though theoretically =
they have nothing in common, as Osama bin Laden just announced, "in the =
current circumstances, the interests of Muslims coincide with the =
interests of the socialists" -- opposing America.=20
Second, as a result of the massive bloodshed of the =
nationalism-based World Wars, Western Europeans concluded that the =
abolition of national identities is a moral necessity. Europe's elite =
decided to believe in Europe and the United Nations rather than in their =
individual nations. An English protester, quoted in the Los Angeles =
Times, explained his protest in terms of support of the United Nations, =
not Britain: British Prime Minister Tony Blair "has totally misjudged . =
how destabilizing this (support for America) has been to the United =
Nations. And we believe in the United Nations."=20
Just as Europeans were losing faith in their national identities, =
the United States came to believe even more strongly in its distinct =
national identity. While Europeans and the American Left have more faith =
in the moral judgment of the United Nations, where Libya chairs the =
Human Rights Commission and Syria and China vote in the Security =
Council, most Americans have more faith in America.=20
Third, pacifist ideas dominate European society. Another major =
ideological consequence of the World Wars was the belief that wars are =
wrong, that any evil -- from Communism to Saddam Hussein or North Korea =
owning weapons of mass destruction -- is better than fighting. America, =
on the other hand, believes that it is sometimes better to fight evil. =
The last time many Europeans demonstrated against America was when =
President Ronald Reagan put Pershing missiles in Europe. Europeans =
thought that confronting the Soviets was provocative and wrong.=20
Fourth, Europe passionately affirms secularism, while America =
remains the most religious among the industrialized democracies. In this =
sphere, too, either America or Europe is right. And the predominance of =
America, a religious country -- one, no less, that affirms the religion =
the European elites have rejected -- infuriates the Europeans.=20
Positing no transcendent or religious basis for an objective and =
universal standard of good and evil, Europe disdains moral absolutes and =
moral judgments. Whether it was President Reagan calling the Soviet =
Union an "evil empire" or President Bush labeling North Korea, Iran and =
Iraq an "axis of evil," Europeans (and the American Left, whose values =
are identical) found such moral labeling contemptible.=20
Indeed our president personifies all that Europe dislikes in =
America. He comes from the business world, wears an Americans flag on =
his lapel, is ready to go to war against an evil regime, and believes =
deeply in God, in Christianity and America's Judeo-Christian identity. =
He even wears cowboy boots.=20
Thomas Jefferson suggested that the Great Seal of the United =
States depict the Israelites' exodus from Egypt. He and the other =
Founders knew that America's future was and must be based on leaving =
Europe. It is truer now than ever.=20

3. THE TIDE OF MADNESS

The world must stand against the evil that took my son's life.=20
Tomorrow will mark the first anniversary of the day the world =
learned of the murder of my son Daniel Pearl, a reporter for this =
newspaper. It is time to step back and reflect on the significance of =
this tragedy.=20
Much has been written on the new challenges that Danny's murder =
represents to international journalism. But relatively little attention =
was given to one aspect of the motives of the perpetrators, specifically =
to the role of anti-American and anti-Semitic sentiments in the planning =
and execution of the murder. In fact, what shocked and united people =
from all over the world was the nature of those motives.=20
The murder weapon in Danny's case was aimed not at a faceless =
enemy or institution, but at a gentle human being--one whose face is now =
familiar to millions of people around the world. Danny's murderers spent =
a week with him; they must have seen his radiating humanity. Killing him =
so brutally, and in front of a video camera, marked a new low in man's =
inhumanity to man. People of all faiths were thus shocked to realize =
that mankind can still be dragged to such depths by certain myths and =
ideologies.=20
Danny was killed because he represented us, namely the ideals that =
every civilized person aspires to uphold--modernity, openness, =
pluralism, freedom of inquiry, truth, honesty and respect for all =
people. Decent people of all backgrounds have consequently felt =
personally targeted in this crime, and have been motivated to carry on =
Danny's spirit.=20
Reactions to Danny's death varied from community to community. In =
Pakistan, many have condemned the murder as a barbaric act carried out =
by a minority of fanatics at the fringe of society, while some find =
absolution in assuming that Danny was a spy. Sadly, anti-Semitism and =
sympathies with the perpetrators, as revealed in the trial of Omar =
Sheikh, seem to be more widespread than openly admitted. The trial =
itself is at a puzzling standstill, with no date set for appeal =
decision. In Saudi Arabia, the murder video has been used to arouse and =
recruit new members to terrorist organizations. In Europe, Danny's =
murder has been condemned as an attack against journalism, while the =
anti-American, anti-Jewish sentiments were played down considerably. =
This is understandable, considering the anti-American and anti-Western =
sentiment echoed in editorials in some respectable European newspapers.=20
In contrast, Danny's captors concentrated on his Jewish and =
Israeli heritage. Evidently the murderers were confident that Danny's =
Jewish connections were sufficient to license the gruesome murder they =
were about to commit. Such a brazen call to condone the killing of a =
human being by virtue of his religion or heritage is strongly =
reminiscent of the horrors perpetrated by Nazi Germany.=20
In a world governed by reason and leadership, one would expect =
world leaders to immediately denounce such racist calls before they =
become an epidemic. However, President Bush was the only world leader to =
acknowledge the connection between Danny's murder and the rise of =
anti-Semitism: "We reject the ancient evil of anti-Semitism whether it =
is practiced by the killers of Daniel Pearl or by those who burn =
synagogues in France." No European head of state rose to John F. =
Kennedy's "Ich bin ein Berliner" with the morally equivalent statement =
"Today, I am a Jew."=20
Not surprisingly, our unguided world has seen an alarming rise of =
anti-Semitic activity in the past year. Tens of millions of Muslims have =
become unshakably convinced that Jews were responsible for the Sept. 11 =
attack. Egypt's state-controlled television aired a 30-part program =
based on the notorious anti-Semitic book "The Protocols of the Elders of =
Zion," and Egyptians were fed another fantasy, that Jews are plotting to =
take over the world. Syria's defense minister, Mustafa Tlas, released =
the eighth edition of his book, "The Matzah of Zion," in which he =
accuses Jews of using the blood of Christians to bake matzah for =
Passover. And on the sideline, while these flames of hatred were =
consuming sizable chunks of the world's population, traditionally vocal =
champions of antiracism remained silent.=20
Against this tide of madness the world is about to remember Daniel =
Pearl--a Jew, a citizen of the world, and a dialogue maker who formed =
genuine connections among people of different backgrounds. In Danny's =
spirit, we have asked every community that plans to commemorate the =
anniversary of his death to invite a neighboring synagogue, mosque, =
church or temple of different faith to join in a prayer for a sane and =
humane world, a world free of the hatred that took Danny's life. =
Interfaith memorials will take place, starting tonight, in Los Angeles, =
New York, Toronto, London and Jerusalem, with additional services =
planned world-wide.=20
We hope that the combination of multifaith attendance, joint =
statements against intolerance, and the unifying global spirit of the =
day will serve as catalysts for building alliances against the rising =
tide of fanaticism, dehumanization, and xenophobia.=20

4. ON BELGIUM, PRIME MINISTER SHARON AND INTERNATIONAL "JUSTICE"

The irony is palpable. Belgium, a nation that finessed its long =
history of colonial brutality by abandoning almost a million defenseless =
Rwandans to rape and murder, will allow Israel's prime minister to be =
tried for war crimes in its own courts. Although the case has been =
blocked until Mr. Sharon is out of office, once the Israeli leader no =
longer enjoys sovereign immunity he and co-defendant Amos Yaron, former =
IDF Chief of Staff, will be subject to Belgium's judicial jurisdiction. =
This was the ruling of Belgium's highest court on February 12th, which =
further stated that investigation and trial of Sharon could proceed even =
if the defendant were not physically present in country.=20
The case against Sharon and Yaron dates back to 2001, when =
survivors of the 1982 massacres at the Sabra and Shatila refugee camps =
in Beirut filed a criminal complaint holding the two Israelis =
responsible for the deaths of their relatives. In essence, this =
complaint - a blatantly propagandistic use of national and international =
law - blames Jews for the killing of Muslims by Christians. Fittingly, =
Belgium, a country with much to atone from the Holocaust period, is =
entirely comfortable with accepting such a grotesque complaint.=20
Christian militias, not IDF units, did all of the killing in =
Lebanon. Ariel Sharon, then Israel's defense minister, does bear some =
legal command responsibility for the massacres (the relevant principle =
is known as respondeat superior "Let the master answer") but his =
failures were all ones of omission, not commission. He did fail to =
recognize that the Christians would massacre the Muslims, but he was not =
in any way aware that these killings were actually underway. Nor was he =
in any way complicit in the murders. So why prosecute Sharon and Yaron, =
and not those Christians who were directly responsible for the crimes? =
The answer is unspeakable but incontestable: The proposed prosecution =
represents a convenient opportunity for Belgium to continue its =
incessant history of anti-semitism, only this time encouraged by large =
numbers of Arabs living in country. Naturally the two defendants here =
are identified juridically as "Israelis," not as "Jews," but everyone in =
Europe today understands what this really means. Europe today is the =
same as Europe yesterday, only less overt. Israel is always the =
individual Jew in macrocosm; Israel-bashing (especially in Europe) is =
still seldom more than an acceptable cover for "Kill the Jews."=20
In theory, the idea of using national courts for the prosecution =
of international crimes is not only reasonable, but essential. This is =
because our world legal order remains largely decentralized - even after =
the recent creation of an International Criminal Court. But the =
principle is perverted, inexcusably, when individual states lend =
themselves not to justice, but to propaganda. In this case the Belgian =
perversion of justice is especially hideous, not only because of its =
broad distortion of responsibility and coincident disregard for Arab =
terror, but also because it is being undertaken for the benefit of =
authentic murderers. And while charges were filed in Belgium against =
Yasser Arafat in November 2001 by relatives of Jewish victims of PLO =
terrorism, the authorities have yet to act upon this particular =
complaint.=20
Belgium's unique tilt toward twisted justice has multiple causes =
and multiple ironies. Today, large numbers of Arab Muslims in Belgium =
hold the country hostage to spoken and unspoken threats. The result is =
that long- latent indigenous anti-semitism - European anti-semitism - is =
now reinforced and reinvigorated by virulent Islamic hatred of Jews. =
Belgium, a country that shamelessly identifies its right to prosecute a =
Jewish leader for crimes committed by Christians against Muslims, is the =
nation that brought genocide to the Congo Free State and that stood =
aside as genocide was committed in the former Belgian colony of Rwanda. =
There, cowardly Belgian troops fled in disgrace before small ragtag =
bands of Hutu killers, consciously abandoning hundreds of thousands of =
Tutsi men, women and children to the mercies of Hutu machettes. This is =
the same "lawful" nation that, with little reluctance, deported 35,000 =
Jews - fully half of the Belgian Jewish population at the time - to =
German gas chambers. This is the same "just" nation that currently joins =
France and Germany (two similarly "just" nations) to prevent NATO =
protection for member-state Turkey from Iraqi weapons of mass =
destruction. As for prosecution of Saddam Hussein in Belgian courts, of =
course, there is nary a murmur. After all, his crimes, like those of the =
Belgians themselves, are not sufficiently serious.=20
Crimes of war and crimes against humanity of the sort committed by =
Saddam Hussein and Yasser Arafat mandate universal cooporation in =
apprehension and punishment. All countries, as responsible punishers of =
"Grave Breaches" under international law, are required to search out and =
prosecute, or extradite, authentic perpetrators. According to Article =
146 of the Fourth Geneva Convention, from which this requirement =
derives, each country "shall bring such persons, regardless of their =
nationality, before its own courts." Without far-reaching compliance =
here, all countries of the world would agree that true justice is =
unimportant.=20
Belgium, unlike any other state on earth, has taken these sacred =
principles and manipulated them for reasons of domestic cowardice and =
deep-seated hatreds. Caving in to Arab threats internally, Belgian =
authorities have agreed to the most unseemly distortions of fact and law =
to buy off Islamic terrorists. All this from a country with precious =
little honor in its history - a country that already has a great deal of =
genocidal blood on its hands, African blood and Jewish blood.=20
Unlike the Belgians, in the matter of universal jurisdiction for =
crimes, a small number of states have in fact acted on behalf of Geneva =
Convention IV. Significantly, one such state is Israel, a tiny ministate =
that is vastly more vulnerable than one lying in the heart of Europe =
with no enemies outside its borders. When Israel abducted Nazi war =
criminal Adolph Eichmann from Argentina in 1960 and brought him to trial =
in Jerusalem, it did so in fulfillment of genuine legal and moral =
obligations. Unable to gain custody of this mass murderer through the =
usual mechanisms of extradition (Argentina was hardly inclined to =
extradite Nazi functionaries after they had brought huge amounts of gold =
into the country, gold extracted from Jewish teeth), Israel's abduction =
was entirely consistent with basic principles of law and justice. The =
crimes set forth by Israeli law, namely crimes of war and crimes against =
humanity, had been established unambiguously as crimes by the Nuremberg =
Tribunal. All of the crimes set forth under the Israeli indictment had =
been recognized by the universal conscience of humankind as delicta =
juris gentium, crimes against the Law of Nations.=20
An international criminal tribunal that might have judged these =
terrible crimes had not yet been created. Nuremberg had dealt only with =
"humanity," and not with the "Jewish People." Israel then invested its =
legislative and judicial organs of state with lawful power of =
enforcement.=20
In so doing, it acted CORRECTLY upon the obligation to punish =
egregious crime under international law, not - in the fashion of the =
Belgians - as a propaganda agent for true criminals. In undertaking to =
punish crimes of genocide, Israel acted to secure justice not only for =
itself and for the Jewish People, but also for the entire community of =
humankind. By accepting concretely the PROPER principle of "universal =
jurisdiction," it established beyond any reasonable doubt that the =
punishment of authentic hostes humani generis - a "common enemy of =
humankind" - is not an internal question for any one state, but a basic =
obligation for all.=20
The difference between the Israeli prosecution of Adolph Eichmann =
and Belgium's proposed prosecution of Ariel Sharon and Amos Yaron is the =
difference between justice and injustice. Confronted with the same =
obligations under international law, Israel chose to meet its =
obligations with intellect, honor and purpose. Belgium, on the other =
hand, has willingly sacrificed justice on the altar of ancient prejudice =
and persistent cowardice. Perhaps, in the months and years ahead, wiser =
heads may prevail in Brussels, and Belgium could begin a markedly more =
dignified path to understanding and courage. It would be a good =
beginning.=20

resurgent anti-Semitism (and that of France as well), a strong, =
German-dominated EU that tolerates and even benignly encourages =
anti-Semitism, and is diplomatically allied with the Arab world, is =

have made the case to the American government and the Jewish =

the US that the Jewish communities Israel established beyond =

armistice lines has been some kind of criminal act, and that these =
Jewish=20
communities somehow stand as an obstacle to peace.=20
<P>It would surprise most people to know that the Israeli Jewish=20
communities of Judea, Samaria, Katif (Gaza) (Yesha) and the Golan =
Heights=20
have not displaced a single Arab village, because of a principle =
laid down=20
by Prime Minister Menachem Begin in 1977. Begin insisted that no =
Jewish=20
town in the areas to be settled by Israel would displace an Arab =
village -=20
unlike the policies of the Israeli Labor party, which - as a =
matter of=20
policy - built Jewish communities to replace the 531 Arab villages =
abandoned by their Arab residents during the 1948 war.=20
<P>Yet the PLO/Peace-Now misinformation machine, working with =
funding from=20
the European Union, has set up an organization known as =
"Settlement=20
Watch", which swamps the media with timely reports that portray =
the Jewish=20
residents of Yesha as criminal interlopers who have encroached on =
Arab=20
land. An array of human rights organizations, all funded through =
the New=20
Israel Fund (NIF) and the EU, overwhelm the media with supportive =
data,=20
with the aim of painting the ugliest picture possible of the =
Jewish=20
residents of these areas. All you have to do is to read the =
reports of=20
B'tzelem, the human rights organization, funded by the NIF and the =
EU and=20
staffed by Arab researchers sympathetic to the PLO, and you will =
get the=20
idea that the Jews of Yesha must have been trained by gangster =
Louis=20
Lepke's Murder, Incorporated.=20
<P>What the PLO and Peace Now do to "sell" their claim of the=20
"settler-criminals" to the media is to operate tours of the Jewish =
communities of Yesha for the clueless foreign media. We have =
confirmed=20
with Peace Now spokesmen that they actually tell the reporters =
that the=20
settlers live in caves, waiting in ambush to pounce on passing =
Arab=20
vehicles. We have also confirmed with Peace Now spokesmen that =
they will=20
actually stand on top of a hill overlooking Gush Etzion with their =
media=20
guests and say to them that the entire area was stolen from Arab =
farmers,=20
portraying the Jews there as the personification of "apartheid on =
the=20
prairie".=20
<P>To paraphrase the Nazi propagandist Josef Goebels, a lie =
repeated often=20
enough becomes believable. A lie which is repeatedly sold to the =
media=20
with no rebuttal becomes part of the media gospel.=20
<P>It is difficult to forget the Peace Now press conference in =
November,=20
2000, when Peace Now appealed to the PLO to stop firing in the =
direction=20
of the Jerusalem neighborhood of Gilo. Only in the direction of =
Gilo.=20
Murdering Jews elsewhere beyond the =93Green Line=94 was therefore =
permissible.=20
<P>The strategy of demonizing the Jewish population of Yesha was =
formally=20
proposed to Prime Minister Yitzhak Rabin by his public relations =
maven,=20
Yekutiel Federman, on the pages of the Mapam political =
publication, Al=20
HaMishmar, in October 1993. Federman's strategy was carefully =
adopted as=20
the methodology of promoting the Oslo process. In depends on =

Europeans demonstrating against America, many Americans, raised to =
regard=20
Europe as an ally, must be wondering what is happening. Some =
Americans=20
even may be wondering if Europe may be right: after all, when have =
millions of Europeans ever been wrong?=20
<P>It is therefore essential that Americans understand the nature =
of the=20
rift between America and Western Europe (not Eastern Europe, which =
thanks=20
to its suffering under Communist evil, understands evil and values =
America) -- a rift that will only widen unless one adopts the =
values of=20
the other. For at this moment, there are two civilizational wars =
taking=20
place: Islamist hostility to Western liberty and European =
hostility to=20
American values.=20
<P>Why this European hostility?=20
<P>First, Europe believes in socialism, while America believes in=20
capitalism. This difference can hardly be overstated. Most Western =
Europeans believe in socialism as fervently as religious =
Christians, Jews=20
and Muslims believe in their respective religions. To many =
Americans,=20
socialism is only an economic system, but for Western Europeans it =
has=20
largely replaced Christianity as their faith.=20
<P>The United States not only rejects socialism; it is the chief =
obstacle=20
to its spread -- because of its military and cultural might, and=20
especially because of its economic success. Indeed, America is the =
chief=20
impediment to the spread of both Islam and socialism. This =
explains the=20
unity of leftist and Muslim activists. Though theoretically they =
have=20
nothing in common, as Osama bin Laden just announced, "in the =
current=20
circumstances, the interests of Muslims coincide with the =
interests of the=20
socialists" -- opposing America.=20
<P>Second, as a result of the massive bloodshed of the =
nationalism-based=20
World Wars, Western Europeans concluded that the abolition of =
national=20
identities is a moral necessity. Europe's elite decided to believe =
in=20
Europe and the United Nations rather than in their individual =
nations. An=20
English protester, quoted in the Los Angeles Times, explained his =
protest=20
in terms of support of the United Nations, not Britain: British =
Prime=20
Minister Tony Blair "has totally misjudged . how destabilizing =
this=20
(support for America) has been to the United Nations. And we =
believe in=20
the United Nations."=20
<P>Just as Europeans were losing faith in their national =
identities, the=20
United States came to believe even more strongly in its distinct =
national=20
identity. While Europeans and the American Left have more faith in =
the=20
moral judgment of the United Nations, where Libya chairs the Human =
Rights=20
Commission and Syria and China vote in the Security Council, most=20
Americans have more faith in America.=20
<P>Third, pacifist ideas dominate European society. Another major=20
ideological consequence of the World Wars was the belief that wars =
are=20
wrong, that any evil -- from Communism to Saddam Hussein or North =
Korea=20
owning weapons of mass destruction -- is better than fighting. =
America, on=20
the other hand, believes that it is sometimes better to fight =
evil. The=20
last time many Europeans demonstrated against America was when =
President=20
Ronald Reagan put Pershing missiles in Europe. Europeans thought =
that=20
confronting the Soviets was provocative and wrong.=20
<P>Fourth, Europe passionately affirms secularism, while America =
remains=20
the most religious among the industrialized democracies. In this =
sphere,=20
too, either America or Europe is right. And the predominance of =
America, a=20
religious country -- one, no less, that affirms the religion the =
European=20
elites have rejected -- infuriates the Europeans.=20
<P>Positing no transcendent or religious basis for an objective =
and=20
universal standard of good and evil, Europe disdains moral =
absolutes and=20
moral judgments. Whether it was President Reagan calling the =
Soviet Union=20
an "evil empire" or President Bush labeling North Korea, Iran and =
Iraq an=20
"axis of evil," Europeans (and the American Left, whose values are =
identical) found such moral labeling contemptible.=20
<P>Indeed our president personifies all that Europe dislikes in =
America.=20
He comes from the business world, wears an Americans flag on his =
lapel, is=20
ready to go to war against an evil regime, and believes deeply in =
God, in=20
Christianity and America's Judeo-Christian identity. He even wears =
cowboy=20
boots.=20
<P>Thomas Jefferson suggested that the Great Seal of the United =
States=20
depict the Israelites' exodus from Egypt. He and the other =
Founders knew=20
that America's future was and must be based on leaving Europe. It =
is truer=20
now than ever.=20

the first anniversary of the day the world learned of the murder =
of my son=20
Daniel Pearl, a reporter for this newspaper. It is time to step =
back and=20
reflect on the significance of this tragedy.=20
<P>Much has been written on the new challenges that Danny's murder =
represents to international journalism. But relatively little =
attention=20
was given to one aspect of the motives of the perpetrators, =
specifically=20
to the role of anti-American and anti-Semitic sentiments in the =
planning=20
and execution of the murder. In fact, what shocked and united =
people from=20
all over the world was the nature of those motives.=20
<P>The murder weapon in Danny's case was aimed not at a faceless =
enemy or=20
institution, but at a gentle human being--one whose face is now =
familiar=20
to millions of people around the world. Danny's murderers spent a =
week=20
with him; they must have seen his radiating humanity. Killing him =
so=20
brutally, and in front of a video camera, marked a new low in =
man's=20
inhumanity to man. People of all faiths were thus shocked to =
realize that=20
mankind can still be dragged to such depths by certain myths and=20
ideologies.=20
<P>Danny was killed because he represented us, namely the ideals =
that=20
every civilized person aspires to uphold--modernity, openness, =
pluralism,=20
freedom of inquiry, truth, honesty and respect for all people. =
Decent=20
people of all backgrounds have consequently felt personally =
targeted in=20
this crime, and have been motivated to carry on Danny's spirit.=20
<P>Reactions to Danny's death varied from community to community. =
In=20
Pakistan, many have condemned the murder as a barbaric act carried =
out by=20
a minority of fanatics at the fringe of society, while some find=20
absolution in assuming that Danny was a spy. Sadly, anti-Semitism =
and=20
sympathies with the perpetrators, as revealed in the trial of Omar =
Sheikh,=20
seem to be more widespread than openly admitted. The trial itself =
is at a=20
puzzling standstill, with no date set for appeal decision. In =
Saudi=20
Arabia, the murder video has been used to arouse and recruit new =
members=20
to terrorist organizations. In Europe, Danny's murder has been =
condemned=20
as an attack against journalism, while the anti-American, =
anti-Jewish=20
sentiments were played down considerably. This is understandable,=20
considering the anti-American and anti-Western sentiment echoed in =
editorials in some respectable European newspapers.=20
<P>In contrast, Danny's captors concentrated on his Jewish and =
Israeli=20
heritage. Evidently the murderers were confident that Danny's =
Jewish=20
connections were sufficient to license the gruesome murder they =
were about=20
to commit. Such a brazen call to condone the killing of a human =
being by=20
virtue of his religion or heritage is strongly reminiscent of the =
horrors=20
perpetrated by Nazi Germany.=20
<P>In a world governed by reason and leadership, one would expect =
world=20
leaders to immediately denounce such racist calls before they =
become an=20
epidemic. However, President Bush was the only world leader to =
acknowledge=20
the connection between Danny's murder and the rise of =
anti-Semitism: "We=20
reject the ancient evil of anti-Semitism whether it is practiced =
by the=20
killers of Daniel Pearl or by those who burn synagogues in =
France." No=20
European head of state rose to John F. Kennedy's "Ich bin ein =
Berliner"=20
with the morally equivalent statement "Today, I am a Jew."=20
<P>Not surprisingly, our unguided world has seen an alarming rise =
of=20
anti-Semitic activity in the past year. Tens of millions of =
Muslims have=20
become unshakably convinced that Jews were responsible for the =
Sept. 11=20
attack. Egypt's state-controlled television aired a 30-part =
program based=20
on the notorious anti-Semitic book "The Protocols of the Elders of =
Zion,"=20
and Egyptians were fed another fantasy, that Jews are plotting to =
take=20
over the world. Syria's defense minister, Mustafa Tlas, released =
the=20
eighth edition of his book, "The Matzah of Zion," in which he =
accuses Jews=20
of using the blood of Christians to bake matzah for Passover. And =
on the=20
sideline, while these flames of hatred were consuming sizable =
chunks of=20
the world's population, traditionally vocal champions of =
antiracism=20
remained silent.=20
<P>Against this tide of madness the world is about to remember =
Daniel=20
Pearl--a Jew, a citizen of the world, and a dialogue maker who =
formed=20
genuine connections among people of different backgrounds. In =
Danny's=20
spirit, we have asked every community that plans to commemorate =
the=20
anniversary of his death to invite a neighboring synagogue, =
mosque, church=20
or temple of different faith to join in a prayer for a sane and =
humane=20
world, a world free of the hatred that took Danny's life. =
Interfaith=20
memorials will take place, starting tonight, in Los Angeles, New =
York,=20
Toronto, London and Jerusalem, with additional services planned=20
world-wide.=20
<P>We hope that the combination of multifaith attendance, joint =
statements=20
against intolerance, and the unifying global spirit of the day =
will serve=20
as catalysts for building alliances against the rising tide of =
fanaticism,=20
dehumanization, and xenophobia.=20

Although the case has been blocked until Mr. Sharon is out of =
office, once=20
the Israeli leader no longer enjoys sovereign immunity he and =
co-defendant=20
Amos Yaron, former IDF Chief of Staff, will be subject to =
Belgium's=20
judicial jurisdiction. This was the ruling of Belgium's highest =
court on=20
February 12th, which further stated that investigation and trial =
of Sharon=20
could proceed even if the defendant were not physically present in =
country.=20
<P>The case against Sharon and Yaron dates back to 2001, when =
survivors of=20
the 1982 massacres at the Sabra and Shatila refugee camps in =
Beirut filed=20
a criminal complaint holding the two Israelis responsible for the =
deaths=20

<P>Christian militias, not IDF units, did all of the killing in =

Ariel Sharon, then Israel's defense minister, does bear some legal =

responsibility for the massacres (the relevant principle is known =

respondeat superior "Let the master answer") but his failures were =

ones of omission, not commission. He did fail to recognize that =
the=20
Christians would massacre the Muslims, but he was not in any way =
aware=20
that these killings were actually underway. Nor was he in any way=20
complicit in the murders. So why prosecute Sharon and Yaron, and =
not those=20
Christians who were directly responsible for the crimes? The =
answer is=20
unspeakable but incontestable: The proposed prosecution represents =
a=20
convenient opportunity for Belgium to continue its incessant =
history of=20
anti-semitism, only this time encouraged by large numbers of Arabs =
living=20
in country. Naturally the two defendants here are identified =
juridically=20
as "Israelis," not as "Jews," but everyone in Europe today =
understands=20
what this really means. Europe today is the same as Europe =
yesterday, only=20
less overt. Israel is always the individual Jew in macrocosm;=20
Israel-bashing (especially in Europe) is still seldom more than an =
acceptable cover for "Kill the Jews."=20
<P>In theory, the idea of using national courts for the =
prosecution of=20
international crimes is not only reasonable, but essential. This =
is=20
because our world legal order remains largely decentralized - even =
after=20
the recent creation of an International Criminal Court. But the =
principle=20
is perverted, inexcusably, when individual states lend themselves =
not to=20
justice, but to propaganda. In this case the Belgian perversion of =
justice=20
is especially hideous, not only because of its broad distortion of =
responsibility and coincident disregard for Arab terror, but also =
because=20
it is being undertaken for the benefit of authentic murderers. And =
while=20
charges were filed in Belgium against Yasser Arafat in November =
2001 by=20
relatives of Jewish victims of PLO terrorism, the authorities have =
yet to=20
act upon this particular complaint.=20
<P>Belgium's unique tilt toward twisted justice has multiple =
causes and=20
multiple ironies. Today, large numbers of Arab Muslims in Belgium =
hold the=20
country hostage to spoken and unspoken threats. The result is that =
long-=20
latent indigenous anti-semitism - European anti-semitism - is now=20
reinforced and reinvigorated by virulent Islamic hatred of Jews. =
Belgium,=20
a country that shamelessly identifies its right to prosecute a =
Jewish=20
leader for crimes committed by Christians against Muslims, is the =
nation=20
that brought genocide to the Congo Free State and that stood aside =
as=20
genocide was committed in the former Belgian colony of Rwanda. =

cowardly Belgian troops fled in disgrace before small ragtag bands =
of Hutu=20
killers, consciously abandoning hundreds of thousands of Tutsi =
men, women=20
and children to the mercies of Hutu machettes. This is the same =
"lawful"=20
nation that, with little reluctance, deported 35,000 Jews - fully =
half of=20
the Belgian Jewish population at the time - to German gas =
chambers. This=20
is the same "just" nation that currently joins France and Germany =

similarly "just" nations) to prevent NATO protection for =
member-state=20
Turkey from Iraqi weapons of mass destruction. As for prosecution =
of=20
Saddam Hussein in Belgian courts, of course, there is nary a =
murmur. After=20
all, his crimes, like those of the Belgians themselves, are not=20
sufficiently serious.=20
<P>Crimes of war and crimes against humanity of the sort committed =
by=20
Saddam Hussein and Yasser Arafat mandate universal cooporation in=20
apprehension and punishment. All countries, as responsible =
punishers of=20
"Grave Breaches" under international law, are required to search =
out and=20
prosecute, or extradite, authentic perpetrators. According to =
Article 146=20
of the Fourth Geneva Convention, from which this requirement =
derives, each=20
country "shall bring such persons, regardless of their =
nationality, before=20
its own courts." Without far-reaching compliance here, all =
countries of=20
the world would agree that true justice is unimportant.=20
<P>Belgium, unlike any other state on earth, has taken these =
sacred=20
principles and manipulated them for reasons of domestic cowardice =
and=20
deep-seated hatreds. Caving in to Arab threats internally, Belgian =
authorities have agreed to the most unseemly distortions of fact =
and law=20
to buy off Islamic terrorists. All this from a country with =
precious=20
little honor in its history - a country that already has a great =
deal of=20
genocidal blood on its hands, African blood and Jewish blood.=20
<P>Unlike the Belgians, in the matter of universal jurisdiction =
for=20
crimes, a small number of states have in fact acted on behalf of =
Geneva=20
Convention IV. Significantly, one such state is Israel, a tiny =
ministate=20
that is vastly more vulnerable than one lying in the heart of =
Europe with=20
no enemies outside its borders. When Israel abducted Nazi war =
criminal=20
Adolph Eichmann from Argentina in 1960 and brought him to trial in =
Jerusalem, it did so in fulfillment of genuine legal and moral=20
obligations. Unable to gain custody of this mass murderer through =
the=20
usual mechanisms of extradition (Argentina was hardly inclined to=20
extradite Nazi functionaries after they had brought huge amounts =
of gold=20
into the country, gold extracted from Jewish teeth), Israel's =
abduction=20
was entirely consistent with basic principles of law and justice. =
The=20
crimes set forth by Israeli law, namely crimes of war and crimes =
against=20
humanity, had been established unambiguously as crimes by the =
Nuremberg=20
Tribunal. All of the crimes set forth under the Israeli indictment =
had=20
been recognized by the universal conscience of humankind as =
delicta juris=20
gentium, crimes against the Law of Nations.=20
<P>An international criminal tribunal that might have judged these =
terrible crimes had not yet been created. Nuremberg had dealt only =
with=20
"humanity," and not with the "Jewish People." Israel then invested =
its=20
legislative and judicial organs of state with lawful power of =
enforcement.=20
<P>In so doing, it acted CORRECTLY upon the obligation to punish =
egregious=20
crime under international law, not - in the fashion of the =
Belgians - as a=20
propaganda agent for true criminals. In undertaking to punish =
crimes of=20
genocide, Israel acted to secure justice not only for itself and =
for the=20
Jewish People, but also for the entire community of humankind. By=20
accepting concretely the PROPER principle of "universal =
jurisdiction," it=20
established beyond any reasonable doubt that the punishment of =
authentic=20
hostes humani generis - a "common enemy of humankind" - is not an =
internal=20
question for any one state, but a basic obligation for all.=20
<P>The difference between the Israeli prosecution of Adolph =
Eichmann and=20
Belgium's proposed prosecution of Ariel Sharon and Amos Yaron is =

difference between justice and injustice. Confronted with the same =
obligations under international law, Israel chose to meet its =
obligations=20
with intellect, honor and purpose. Belgium, on the other hand, has =
willingly sacrificed justice on the altar of ancient prejudice and =
persistent cowardice. Perhaps, in the months and years ahead, =
wiser heads=20
may prevail in Brussels, and Belgium could begin a markedly more =
dignified=20
path to understanding and courage. It would be a good beginning.=20
