1. LANDMARKS DURING WAR=20

JERUSALEM -- This is no place for an atheist or even a suave =
agnostic. From my window on the top floor of the massive King David =
Hotel, I am looking out on a stone heap that is thousands of years old, =
the Old City of Jerusalem. Traffic swarms around its walls. Antennas =
sprout from the old roofs of the city. Airplanes fly overhead. Still, =
religion dominates here -- sometimes in ways that might persuade even =
the most obdurate nonbeliever to give God a second look, and other times =
in ways that could get a nonbeliever locked away in the hoosegow. Some =
religious people can be very intolerant.=20
As Christmas approaches, American Christians might take note of =
the intolerance here. Their sacred shrines -- and some belonging to =
Judaism -- are under threat from the Islamofascists of the Palestinian =
Authority. What is more, the Christian population of the West Bank is =
not being treated as hospitably by Yasser Arafat's colleagues as, say, =
the Muslim population of Detroit is being treated.=20
First, let me explain why an atheist's faith or faithlessness =
might be shaken here in Jerusalem. Most atheists and agnostics put great =
stock in science. Unfortunately, archaeology is no longer on their side. =
For over a generation, archaeologists -- led by such distinguished =
scholars as Kathleen Kenyon -- have been unearthing ruins that, as the =
historian Paul Johnson writes, have "given us renewed confidence in the =
actual existence of places and events described in the early Old =
Testament books."=20
Just the other day, an Israeli archaeologist took me through a =
3,800-year-old passageway where old Jerusalem's early inhabitants, the =
Jebusites, and later King David collected water for what became the old =
city of Jerusalem. Then he showed me a relatively new dig in the =
passageway, whose characteristics perplexed archaeologists until someone =
remembered a passage in the Book of Kings.=20
I was standing precisely where King David had Solomon anointed =
3,000 years ago. I am by nature a skeptic, but cross-referencing the =
hard evidence of archaeology with Biblical passages makes a strong case. =
The archaeological site is called Ir David. It constitutes a massive =
endorsement of Biblical authenticity and is eminently deserving of =
book-length treatment.=20
There are other digs in the Old City that are not so encouraging. =
Whereas the Israelis respect sacred places, the Palestinian Authority =
does not. Their police have taken over the Temple Mount with the =
sufferance of the Israeli government that controls it. Against the will =
of Jews and Christians, who judge it sacred, and of archaeologists, who =
consider it worthy of careful study, these religious bigots are carting =
away tons of ancient earth to build a huge mosque for political =
purposes. They are defiling a sacred and archaeologically invaluable =
location on a 3,000-year-old site to establish a political claim to the =
site, and no one is stopping them.=20
The desecration is not unprecedented. Think back four years ago, =
to when the Taliban conspired in the destruction of the ancient Buddhist =
statues in Afghanistan.=20
I know our government tells us that Islam is a very tolerant and =
pious religion, but I see many signs that it is neither. The fact is =
that here in a region where Israeli political control has preserved =
sacred shrines for all three of the monotheistic religions, Palestinian =
Muslims under the Palestinian Authority set up after the Oslo Accords =
have desecrated holy places, brutalized non-Muslims and driven =
Christians from Bethlehem after indulging in some gerrymandering that =
would stir admiration in an American politician.=20
Surely you remember last April when Palestinian militants (gunmen) =
took over Bethlehem's Church of the Nativity, booby-trapped its entrance =
and terrorized 150 worshipers for 39 days while eating the clerics' =
provisions, quaffing their booze -- so much for Allah's blue laws -- =
stealing church valuables such as gold crucifixes and using sacred =
scriptures for toilet paper (ah, cleanliness). That sort of barbarism is =
not new.=20
Earlier, Arafat summarily seized a Greek Orthodox monastery near =
the Church of the Nativity to serve as his occasional residence. In =
Hebron in 1997, his thugs seized Abraham's Oak Russian Holy Trinity =
Monastery, evicting its monks and nuns.=20
Since his latest Intifada began in 2000, he has regularly =
stationed his artillery and sharpshooters in Christian towns near =
churches to either shield his gunmen or bring Israeli fire down on =
places of worship.=20
Returning to our archaeological theme, in Jerusalem Palestinian =
Authority officers have endangered the walls of the Church of the Holy =
Sepulcher by attempting to construct a facility on its roof, a latrine =
-- again, this Islamic fascination with bodily functions.=20
The destruction of holy sites runs apace with the destruction of =
Christian communities on the West Bank. Sometimes it is through =
heavy-handed political schemes as when Arafat's Palestinian Authority =
incorporated 30,000 Palestinians into the municipality of Bethlehem, =
changing the Christians' 60 percent majority to a minority. Sometimes it =
is through terror. News accounts mount of Christians being beaten, =
raped, murdered and charged by protections rackets. In Bethlehem and =
even in Jerusalem, Christian numbers dwindle. There has been very little =
complaint about these bigoted acts, but any curious observer here in =
this ancient city does not have to research very sedulously to find out =
the depressing facts.=20
The Holy Land has suffered Roman legions, crusaders, the armies of =
the Prophet, Turks, two World Wars and more. But its archaeological =
treasures have endured. Its religious minorities have had good times and =
bad. Now both face bad times, unless civilized forces can maintain the =
peace and tolerance that so many fanatics make a mockery of.=20

2. ARAFAT ORDERS CHRISTMAS CANCELED=20

Last year, Arafat declared Jesus a Muslim and made a big show of =
trying to attend the Catholic Christmas mass after being forbidden to do =
so by Israel. Arafat got fabulous global coverage, portraying him as a =
victim of Israeli religious "intolerance." (Remember =96 Arafat-Muslim, =
Israel-Jew, Christmas-Christian =96 how did Christ get involved, here?)=20
A declaration by Yasser Arafat that Jesus was a Muslim does not =
make Arafat a Catholic. In any case, barring Muslim Arafat from =
attending Christian Mass last year was evidence of "Israeli religious =
intolerance," but nobody is calling Muslim Arafat "intolerant" for =
canceling Christmas for Christians this year.=20
Am I the only one wondering what this is all about? I note that =
Israel denying a Muslim his Christmas celebration is intolerant, but a =
Muslim denying the Christian world the same thing is not.=20
Why is that? Well, here's a hint. Both Christians and Jews worship =
the God of the Bible. Islam does not.=20
In any case, Yasser Arafat has decided to punish Israel for =
reoccupying Bethlehem by canceling Christmas. Speaking to reporters at =
his Ramallah office, Arafat called the army's decision to declare =
Bethlehem a closed military zone until the end of the year a "crime."=20
"These [Israeli] measures mean that there is no Christmas this =
year," Arafat said. Now that's power! Arafat, a Muslim, to punish =
Israel, a Jewish state, has decided to cancel Christmas, a Christian =
holiday.=20
Arafat the Muslim says that if the Jewish state behaves itself, =
he'll un-cancel the Christian Christmas in Bethlehem. Speaking through =
Palestinian "sources," Arafat let it be known that his decision would be =
rescinded if the Israeli Defense Forces leave the city.=20
Immediately after canceling Christmas, Arafat appealed directly to =
the pope to intervene, according to the Jerusalem Post. ("Stop me, =
before I cancel New Year's and Easter!") He took his case to the =
"international community" (the media) as well, demanding they condemn =
the Israeli "invasion" of Bethlehem and demanding they put pressure on =
the Israelis to pull out.=20
But every single time Israel does pull out, the terrorists regroup =
and attack another Israeli target. So Arafat is, in essence, using the =
occasion of the birth of Christ to facilitate additional murders against =
Israeli women and children.=20
According to statistics compiled by the IDF, as of Nov. 17, 2002, =
there had been a total of 15,298 Palestinian terror attacks against =
Israel since the intifada began in September 2000.=20
No other modern state has endured that many attacks in a 2-year =
period. Arafat and Company have set a record that nobody hopes to ever =
see broken.=20
And now, having already taken Israel's security hostage and while =
holding the rest of the Middle East hostage, threatening to plunge the =
entire region into war if his demands are not met, Arafat decided this =
would be a good time to take Christmas hostage. But it isn't about =
Arafat canceling Christmas. Obviously, that is just the delusional stage =
of advanced megalomania speaking.=20
It's about the silence of the Christian world at Arafat's effort =
to hold Christianity symbolically hostage. Where is the outrage at his =
cynical effort to use Christianity as part of his propaganda war?=20
Arafat claims Jesus and Bethlehem for Islam, and threatens to ring =
the Church of the Nativity with assassins unless Israel bends to his =
political demands.=20

3. PUTTING ARAFAT ON TRIAL=20

O On Thursday, December 12 the Tel Aviv District Court ruled for =
the second time that Israel has a moral and legal right to put captured =
Fatah Tanzim chief Marwan Barghouti on trial for his crimes against =
humanity =96 more specifically, against the Jewish people.=20
Barghouti, a senior Palestinian leader and member of the =
Palestinian Legislative Council (PLC), was apprehended by security =
forces in April 2002, and has been charged with murder, conspiracy to =
murder and incitement to murder, among other things. Palestinians have =
long hailed him as the leader of the Tanzim terrorist organization - a =
=93military=94 wing of Yasser Arafat=92s Fatah, which has claimed =
responsibility for more attacks against Israelis during the past 26 =
months than any other Palestinian terror group.=20
While Israeli officials promised a public and indicting =
prosecution of Barghouti, his court appearances thus far have focused on =
whether or not Israel has a right to put him on trial at all.=20
Barghouti=92s lawyers, both Arab and Jewish, have vehemently =
argued that Israel has no jurisdiction over a man who is merely a =
=93freedom fighter fighting against the occupation.=94 Simultaneously, =
they have claimed that regardless of the murders Barghouti may be =
responsible for, the Oslo Accords do not afford Israel jurisdiction over =
a =93foreign national=94 from the realm of the Palestinian Authority.=20
Judge Zvi Gurfinkel, however, ruled on Thursday that there exists =
ample evidence that Barghouti was directly responsible for the murder of =
numerous Israeli citizens, and that the Oslo Accords in fact afford =
Israel overriding jurisdiction in matters pertaining to the security of =
Israelis. Furthermore, Gurfinkel stated that the Palestinian =
Authority=92s systematic violation of the Oslo Accords over the past 26 =
months made null and void any articles of the agreements that would =
otherwise protect Barghouti from prosecution.=20
In addition, the judge ruled that Barghouti=92s status as a member =
of the PLC did not provide him with parliamentary immunity in this case, =
as he had willfully engaged in terrorist activities amounting to war =
crimes.=20
The spectacle of the Barghouti trial, and Israel=92s steadfast =
resolve to try the man responsible for the deaths of so many Israelis, =
is at the same time providing the nation with a preview of just how =
viable and doable the arrest and public trial of the greatest killer of =
Jews since Hitler =96 Yasser Arafat =96 could be.=20
While the concept of exile is fast becoming the popular right-wing =
solution in Israel for dealing with Arafat and his continued refusal to =
live up to his Oslo commitments, it patently ignores the PLO chief=92s =
history of the past 20 years.=20
Politicians are understandably reluctant to do any more than exile =
Arafat, as arresting or even assassinating him would without doubt stir =
up a major diplomatic storm on the international scene.=20
Regardless, releasing him into the world at large would offer =
Arafat the opportunity to rebuild his international popularity and =
support, unhindered by IDF raids and other Israeli intervention =96 the =
same kind of popularity and support the terror chieftain-turned-diplomat =
succeeded in building from his Tunis headquarters between 1982-1993, =
which subsequently led to his installation as =93president of =
Palestine.=94=20
"I think that Yasser Arafat has -- it's not for me to characterize =
him, but if one looks historically, he has been involved in terrorist =
activities. We all know that. That's been his background," said the US =
Secretary of Defense in a TV interview in 2001. Substantial evidence =
presented by the IDF over the past year clearly shows that Arafat has =
had no change of heart in the last decade regarding his use of terrorism =
against the Jewish state.=20
Due to other, intensifying Western diplomatic efforts, Israel=92s =
two-year-old window of opportunity to deal with its arch-nemesis with a =
degree of finality will soon be closed. With Arafat now trapped like a =
discredited rat in a cage in Ramallah =96 rather than scurrying around =
free in the despotic Arab world =96 Israel finally has the chance to =
demonstrate with determination that those who have murdered its citizens =
will be brought to justice, and made to pay.=20

Maybe it's time to rethink "The Protocols of the Elders of Zion" =
which are being shown to millions of Arabs on Egyptian television. Maybe =
The Protocols are right. The Jews do run the world.=20
Now hold on a minute. I'm only speaking from personal experience. =
Give me a chance to explain.=20
My father (though trained as a rabbi in the Old Country) worked =
the leather trade 18 hours a day when he brought us to America. Night =
and day he was at the cutting table or the sewing machine and was still =
barely able to support his family -- but how do I know what he did the =
rest of those six hours? My guess is he ran South America.=20
I did hear him speak Spanish several times on the phone. He always =
said it was his one surviving brother on the other end.=20
Right...we're supposed to believe that?=20
No. That was surely Evita on the other end, Dad giving her hell. =
What is she doing to his Argentina!=20
My mother? Oh sure, she played the part of an Old World Mom, =
always extra worried about her husband and kids. Quite a show. But how =
do I know what she did while I was off to school? My guess is that, =
between shopping, bargain hunting and cooking, she was in full control =
of Great Britain.=20
I think she told the Queen what to wear, what not to wear, what to =
say, what not to say -- and surely how to raise those kids.=20
With my mother gone, you see how it's all fallen apart for the =
Royals? No wonder.=20
No, it's absolutely certain that my mother -- though she was never =
taller than 5'2" and spoke no English -- did indeed run the British =
Empire.=20
You think Winston Churchill came up with that "we shall fight them =
on the beaches" speech all by himself? You think it was Winston =
Churchill who came up with the phrase "Iron Curtain?"=20
I was too young when all this was going on to own a country, let =
alone an entire continent, like my father.=20
But given the chance, I'd opt for Europe. I want Europe. First I =
have to find the Protocol People and get the okay -- you know, those =
Jews who sit around and divvy up the world.=20
I just hope Europe is not already taken.=20
If I don't get Europe I'm gonna make trouble.=20
My kids already want Africa and Asia. They're so spoiled.=20
After I talk to the right people, I=B9ll see that my mother-in-law =
gets Monaco, or any place that's got slot machines. Las Vegas will do, =
in a pinch.=20
The trouble is, where to find these Protocol People -- these =
people who divide up the world among the Jews. Phone book? Internet? =
Under what?=20
If I do get Europe (and why shouldn't I?) there's gonna be =
changes. I'm not kidding.=20
Driving on the wrong side of the road -- out!=20
Of course I'll re-introduce myself to the Queen. I'll just mention =
my mother's name, and for sure we=B9re back in business.=20
France, I'm worried about. They don't like...well, anybody. So it =
might take some time to win them over and let me run the place.=20
I'll just tell them who I am...the Protocol People sent me. =
That'll have them shaking.=20
All that will take time, especially when it comes to other parts =
of Europe under my eventual control -- like Sweden, Denmark, Finland and =
all the rest of those places. Oh, Germany, yeah.=20
I'll just tell the Germans, look, I'm here. I'm in charge. Don't =
believe me? Call this number!=20
As the years go by, Europe will have changed. I'll be dealing with =
different leaders. I imagine that the new leader of France will be Abu =
bin Saladin, the Swedish leader will be Mohammed bin Mohammed and so on, =
but they'll make their peace with me because...because they'll know =
who's boss, having read, as they all have, "The Protocols of the Elders =
of Zion."=20
I just don't know what I should wear. I should check with my wife. =
But she's out shopping. Or...so she says.=20

is no place for an atheist or even a suave agnostic. From my =
window on the=20
top floor of the massive King David Hotel, I am looking out on a =
stone=20
heap that is thousands of years old, the Old City of Jerusalem. =
Traffic=20
swarms around its walls. Antennas sprout from the old roofs of the =
city.=20
Airplanes fly overhead. Still, religion dominates here -- =
sometimes in=20
ways that might persuade even the most obdurate nonbeliever to =
give God a=20
second look, and other times in ways that could get a nonbeliever =
locked=20
away in the hoosegow. Some religious people can be very =
intolerant.=20
<P>As Christmas approaches, American Christians might take note of =
the=20
intolerance here. Their sacred shrines -- and some belonging to =
Judaism --=20
are under threat from the Islamofascists of the Palestinian =
Authority.=20
What is more, the Christian population of the West Bank is not =
being=20
treated as hospitably by Yasser Arafat's colleagues as, say, the =
Muslim=20
population of Detroit is being treated.=20
<P>First, let me explain why an atheist's faith or faithlessness =
might be=20
shaken here in Jerusalem. Most atheists and agnostics put great =
stock in=20
science. Unfortunately, archaeology is no longer on their side. =
For over a=20
generation, archaeologists -- led by such distinguished scholars =
as=20
Kathleen Kenyon -- have been unearthing ruins that, as the =
historian Paul=20
Johnson writes, have "given us renewed confidence in the actual =
existence=20
of places and events described in the early Old Testament books."=20
<P>Just the other day, an Israeli archaeologist took me through a=20
3,800-year-old passageway where old Jerusalem's early inhabitants, =
the=20
Jebusites, and later King David collected water for what became =
the old=20
city of Jerusalem. Then he showed me a relatively new dig in the=20
passageway, whose characteristics perplexed archaeologists until =
someone=20
remembered a passage in the Book of Kings.=20
<P>I was standing precisely where King David had Solomon anointed =
3,000=20
years ago. I am by nature a skeptic, but cross-referencing the =
hard=20
evidence of archaeology with Biblical passages makes a strong =
case. The=20
archaeological site is called Ir David. It constitutes a massive=20
endorsement of Biblical authenticity and is eminently deserving of =
book-length treatment.=20
<P>There are other digs in the Old City that are not so =
encouraging.=20
Whereas the Israelis respect sacred places, the Palestinian =
Authority does=20
not. Their police have taken over the Temple Mount with the =
sufferance of=20
the Israeli government that controls it. Against the will of Jews =
and=20
Christians, who judge it sacred, and of archaeologists, who =
consider it=20
worthy of careful study, these religious bigots are carting away =
tons of=20
ancient earth to build a huge mosque for political purposes. They =
are=20
defiling a sacred and archaeologically invaluable location on a=20
3,000-year-old site to establish a political claim to the site, =
and no one=20
is stopping them.=20
<P>The desecration is not unprecedented. Think back four years =
ago, to=20
when the Taliban conspired in the destruction of the ancient =
Buddhist=20
statues in Afghanistan.=20
<P>I know our government tells us that Islam is a very tolerant =
and pious=20
religion, but I see many signs that it is neither. The fact is =
that here=20
in a region where Israeli political control has preserved sacred =
shrines=20
for all three of the monotheistic religions, Palestinian Muslims =
under the=20
Palestinian Authority set up after the Oslo Accords have =
desecrated holy=20
places, brutalized non-Muslims and driven Christians from =
Bethlehem after=20
indulging in some gerrymandering that would stir admiration in an =
American=20
politician.=20
<P>Surely you remember last April when Palestinian militants =
(gunmen) took=20
over Bethlehem's Church of the Nativity, booby-trapped its =
entrance and=20
terrorized 150 worshipers for 39 days while eating the clerics'=20
provisions, quaffing their booze -- so much for Allah's blue laws =
--=20
stealing church valuables such as gold crucifixes and using sacred =
scriptures for toilet paper (ah, cleanliness). That sort of =
barbarism is=20
not new.=20
<P>Earlier, Arafat summarily seized a Greek Orthodox monastery =
near the=20
Church of the Nativity to serve as his occasional residence. In =
Hebron in=20
1997, his thugs seized Abraham's Oak Russian Holy Trinity =
Monastery,=20
evicting its monks and nuns.=20
<P>Since his latest Intifada began in 2000, he has regularly =
stationed his=20
artillery and sharpshooters in Christian towns near churches to =
either=20
shield his gunmen or bring Israeli fire down on places of worship. =
<P>Returning to our archaeological theme, in Jerusalem Palestinian =
Authority officers have endangered the walls of the Church of the =
Holy=20
Sepulcher by attempting to construct a facility on its roof, a =
latrine --=20
again, this Islamic fascination with bodily functions.=20
<P>The destruction of holy sites runs apace with the destruction =
of=20
Christian communities on the West Bank. Sometimes it is through=20
heavy-handed political schemes as when Arafat's Palestinian =
Authority=20
incorporated 30,000 Palestinians into the municipality of =
Bethlehem,=20
changing the Christians' 60 percent majority to a minority. =
Sometimes it=20
is through terror. News accounts mount of Christians being beaten, =
raped,=20
murdered and charged by protections rackets. In Bethlehem and even =
in=20
Jerusalem, Christian numbers dwindle. There has been very little =
complaint=20
about these bigoted acts, but any curious observer here in this =
ancient=20
city does not have to research very sedulously to find out the =
depressing=20
facts.=20
<P>The Holy Land has suffered Roman legions, crusaders, the armies =
of the=20
Prophet, Turks, two World Wars and more. But its archaeological =
treasures=20
have endured. Its religious minorities have had good times and =
bad. Now=20
both face bad times, unless civilized forces can maintain the =
peace and=20
tolerance that so many fanatics make a mockery of.=20

declared Jesus a Muslim and made a big show of trying to attend =

Catholic Christmas mass after being forbidden to do so by Israel. =

got fabulous global coverage, portraying him as a victim of =
Israeli=20
religious "intolerance." (Remember =96 Arafat-Muslim, Israel-Jew,=20
Christmas-Christian =96 how did Christ get involved, here?)=20
<P>A declaration by Yasser Arafat that Jesus was a Muslim does not =
make=20
Arafat a Catholic. In any case, barring Muslim Arafat from =
attending=20
Christian Mass last year was evidence of "Israeli religious =
intolerance,"=20
but nobody is calling Muslim Arafat "intolerant" for canceling =
Christmas=20
for Christians this year.=20
<P>Am I the only one wondering what this is all about? I note that =
Israel=20
denying a Muslim his Christmas celebration is intolerant, but a =
Muslim=20
denying the Christian world the same thing is not.=20
<P>Why is that? Well, here's a hint. Both Christians and Jews =
worship the=20
God of the Bible. Islam does not.=20
<P>In any case, Yasser Arafat has decided to punish Israel for =
reoccupying=20
Bethlehem by canceling Christmas. Speaking to reporters at his =
Ramallah=20
office, Arafat called the army's decision to declare Bethlehem a =
closed=20
military zone until the end of the year a "crime."=20
<P>"These [Israeli] measures mean that there is no Christmas this =
year,"=20
Arafat said. Now that's power! Arafat, a Muslim, to punish Israel, =
a=20
Jewish state, has decided to cancel Christmas, a Christian =
holiday.=20
<P>Arafat the Muslim says that if the Jewish state behaves itself, =
he'll=20
un-cancel the Christian Christmas in Bethlehem. Speaking through=20
Palestinian "sources," Arafat let it be known that his decision =
would be=20
rescinded if the Israeli Defense Forces leave the city.=20
<P>Immediately after canceling Christmas, Arafat appealed directly =
to the=20
pope to intervene, according to the Jerusalem Post. ("Stop me, =
before I=20
cancel New Year's and Easter!") He took his case to the =
"international=20
community" (the media) as well, demanding they condemn the Israeli =
"invasion" of Bethlehem and demanding they put pressure on the =
Israelis to=20
pull out.=20
<P>But every single time Israel does pull out, the terrorists =
regroup and=20
attack another Israeli target. So Arafat is, in essence, using the =
occasion of the birth of Christ to facilitate additional murders =
against=20
Israeli women and children.=20
<P>According to statistics compiled by the IDF, as of Nov. 17, =
2002, there=20
had been a total of 15,298 Palestinian terror attacks against =
Israel since=20
the intifada began in September 2000.=20
<P>No other modern state has endured that many attacks in a 2-year =
period.=20
Arafat and Company have set a record that nobody hopes to ever see =
broken.=20
<P>And now, having already taken Israel's security hostage and =
while=20
holding the rest of the Middle East hostage, threatening to plunge =
the=20
entire region into war if his demands are not met, Arafat decided =
this=20
would be a good time to take Christmas hostage. But it isn't about =
Arafat=20
canceling Christmas. Obviously, that is just the delusional stage =
of=20
advanced megalomania speaking.=20
<P>It's about the silence of the Christian world at Arafat's =
effort to=20
hold Christianity symbolically hostage. Where is the outrage at =
his=20
cynical effort to use Christianity as part of his propaganda war?=20
<P>Arafat claims Jesus and Bethlehem for Islam, and threatens to =
ring the=20
Church of the Nativity with assassins unless Israel bends to his =
political=20
demands.=20

December 12 the Tel Aviv District Court ruled for the second time =

Israel has a moral and legal right to put captured Fatah Tanzim =
chief=20
Marwan Barghouti on trial for his crimes against humanity =96 more =
specifically, against the Jewish people.=20
<P>Barghouti, a senior Palestinian leader and member of the =
Palestinian=20
Legislative Council (PLC), was apprehended by security forces in =
April=20
2002, and has been charged with murder, conspiracy to murder and=20
incitement to murder, among other things. Palestinians have long =
hailed=20
him as the leader of the Tanzim terrorist organization - a =
=93military=94 wing=20
of Yasser Arafat=92s Fatah, which has claimed responsibility for =
more=20
attacks against Israelis during the past 26 months than any other=20
Palestinian terror group.=20
<P>While Israeli officials promised a public and indicting =
prosecution of=20
Barghouti, his court appearances thus far have focused on whether =
or not=20
Israel has a right to put him on trial at all.=20
<P>Barghouti=92s lawyers, both Arab and Jewish, have vehemently =
argued that=20
Israel has no jurisdiction over a man who is merely a =93freedom =
fighter=20
fighting against the occupation.=94 Simultaneously, they have =
claimed that=20
regardless of the murders Barghouti may be responsible for, the =
Oslo=20
Accords do not afford Israel jurisdiction over a =93foreign =
national=94 from=20
the realm of the Palestinian Authority.=20
<P>Judge Zvi Gurfinkel, however, ruled on Thursday that there =
exists ample=20
evidence that Barghouti was directly responsible for the murder of =
numerous Israeli citizens, and that the Oslo Accords in fact =
afford Israel=20
overriding jurisdiction in matters pertaining to the security of =
Israelis.=20
Furthermore, Gurfinkel stated that the Palestinian Authority=92s =
systematic=20
violation of the Oslo Accords over the past 26 months made null =
and void=20
any articles of the agreements that would otherwise protect =
Barghouti from=20
prosecution.=20
<P>In addition, the judge ruled that Barghouti=92s status as a =
member of the=20
PLC did not provide him with parliamentary immunity in this case, =
as he=20
had willfully engaged in terrorist activities amounting to war =
crimes.=20
<P>The spectacle of the Barghouti trial, and Israel=92s steadfast =
resolve to=20
try the man responsible for the deaths of so many Israelis, is at =
the same=20
time providing the nation with a preview of just how viable and =
doable the=20
arrest and public trial of the greatest killer of Jews since =
Hitler =96=20
Yasser Arafat =96 could be.=20
<P>While the concept of exile is fast becoming the popular =
right-wing=20
solution in Israel for dealing with Arafat and his continued =
refusal to=20
live up to his Oslo commitments, it patently ignores the PLO =

<P>Politicians are understandably reluctant to do any more than =
exile=20
Arafat, as arresting or even assassinating him would without doubt =
stir up=20
a major diplomatic storm on the international scene.=20
<P>Regardless, releasing him into the world at large would offer =
Arafat=20
the opportunity to rebuild his international popularity and =
support,=20
unhindered by IDF raids and other Israeli intervention =96 the =
same kind of=20
popularity and support the terror chieftain-turned-diplomat =
succeeded in=20
building from his Tunis headquarters between 1982-1993, which =
subsequently=20
led to his installation as =93president of Palestine.=94=20
<P>"I think that Yasser Arafat has -- it's not for me to =
characterize him,=20
but if one looks historically, he has been involved in terrorist=20
activities. We all know that. That's been his background," said =
the US=20
Secretary of Defense in a TV interview in 2001. Substantial =
evidence=20
presented by the IDF over the past year clearly shows that Arafat =
has had=20
no change of heart in the last decade regarding his use of =
terrorism=20
