My comment:
Yeah, yeah, and Dibold who sold the voting machines to counties across America was owned by someone who contributed himself and was a heavy hitting fundraiser for Bush.
What should we make of that! potential conflict of interest.

>From an earlier post I wrote to a political list I am on which covered the subject of Judge Perkins' recusal when the news broke that he deferred the decision to the regional judge:
 
I have a friend and confidant who served many years before retirement as a
District Judge. He and I spoke by phone during DeLay's appearance in court. 
He expressed astonishment that:
1.) The special treatment DeLay received, (mug shots are NOT supposed to 
be taken with the subject smiling.) and
2.) That the criminal offense does not require judicial recuse for certain reasons
only applies in civic suits.

Perkins could have seized the moment, "Mr. DeGuerin, I must remind you that
this is a criminal case, not a civil trial. I plan to try this case and hereby
deny a change of venue despite the ad campaign that was mounted in order to
taint the jury pool. This court will not be jerked around by an advertising
blitz. Guilt or innocence in this matter is not subject to political party affiliation or
public opinion polling. 

This case is about laws that were allegedly broken by the defendant in a
conspiracy to bypass existing legislation about unlawful corporate contributions 
to candidates. That is what is to be decided by a duly selected jury after hearing and considering all of the evidence presented." 
 
That's what I wanted to hear from Honorable District Judge Bob Perkins.

There is a very important difference, as I was told by my judge friend, between 
KBH's case and this one: A constitutional amendment was passed shortly after the Hutchinson case that allows for prosecutor's appeals. The KBH case was derailed
because that amendment wasn't in place. Now it is.

DeLay judge named 
Bell County District Judge C.W. Duncan has been appointed to decide whether state District Judge Bob Perkins of Austin should continue to preside over former House Majority Leader Tom DeLay's criminal case. A hearing has been set for 10 a.m. Nov. 1 in Austin.
